1. Definitions
- Service means the MT940 Toolkit website available at mt940toolkit.com and wyciag.com.
- Provider means Smartbusiness sp. z o.o., Oginskiego 2/10, 85-236 Bydgoszcz, Poland, NIP 5542964866, REGON 380078217, KRS 0000730289, e-mail: kontakt@smartbusiness.pl or support@mt940toolkit.com.
- User means any person using the Service.
- Customer means a User who uses, intends to purchase, or has purchased the paid Pro Digital Service.
- Consumer means a natural person entering into an agreement not directly related to business or professional activity.
- Digital Service means an electronic service that enables local reading, analysis, filtering, export, or splitting of MT940 files in the User's browser.
- Free Plan means the free Service variant with limits described in the Service.
- Pro Plan means the paid Service variant with fuller MT940 processing and exports described in the Service.
- EasyCart or Easytools means the external sales system used for orders, payments, and Pro access protection.
- Terms means these Terms of Service.
2. General provisions
- These Terms define the rules for using the Service, Free Plan, Pro Plan, orders, payments, complaints, and withdrawal from the agreement.
- The Service is an online tool for MT940 files. It is not a banking, accounting, tax, or advisory service.
- The automated EasyCart purchase path is intended only for Consumers. Checkout does not allow a tax ID or business invoice details; placing an order means a consumer purchase.
- The Provider does not sell physical goods, tangible media, or goods with digital elements. The service is delivered electronically.
- Information visible in the Service, including features, limits, price, technical requirements, and access period, is an invitation to enter into an agreement, not an offer under the Civil Code unless expressly stated otherwise.
3. Scope of the service
- MT940 Toolkit enables loading an MT940 file, previewing transactions, analysing statement sections, filtering, CSV export, PDF report or printout, and splitting MT940 files by month or account if the feature is available in the selected plan.
- The Free Plan is intended for test verification of the tool. It may include limits on visible transactions and different documents remembered in the browser.
- The Pro Plan provides fuller document processing and exports described in the pricing page. Pro features may depend on active access confirmed by EasyCart.
- The Provider may develop the parser, bank profiles, and export formats. Because banks implement MT940 differently, the tool may not support every file variant or may require User verification of results.
4. Local processing of MT940 files
- In the standard Service flow, the MT940 file is read, decoded, parsed, split, and exported locally in the User's browser.
- The Provider does not require sending MT940 file content to a server to perform the basic Service functions.
- The Service may store locally in the User's browser the active document, file history, document hashes, Free Plan counter, table settings, column preferences, and other interface settings.
- Local data remains on the User's device until removed from the Service, cleared from browser storage, or automatically removed by the browser.
- The User should use the Service on a trusted device and trusted browser, especially when working with bank statements containing financial data or third-party data.
5. Order and payment
- A Pro Plan order can be placed through the order form made available in EasyCart or another form indicated in the Service.
- Placing an order requires providing required data, accepting the Terms and Privacy Policy, and paying the order if payment is required before service starts.
- Order handling, payments, purchase confirmations, customer panel, and Pro access protection may be carried out by EasyCart. EasyCart may use Stripe or other checkout payment methods.
- The Customer may be redirected to EasyCart or a payment operator to pay, log in, or confirm the right to Pro access.
- Price, currency, taxes, billing period, subscription renewal, and cancellation rules are shown in the Service or order form before the order is placed.
- In the automated purchase path, the Provider does not issue business invoices with the buyer's tax ID. Purchase confirmations and sales documents follow the consumer character of the order.
- If a Consumer requests an invoice within the legally required time, the Provider will issue an invoice appropriate for consumer sale, without the buyer's tax ID.
- An unpaid order may be cancelled. Missing active payment or subscription expiry may result in loss of Pro Plan access.
6. Start of service and Pro access
- The Pro Plan is made available after the agreement is concluded and payment is confirmed, unless the product description or checkout states otherwise.
- If the Digital Service is made available before the 14-day withdrawal period expires, the Provider may require the Customer's explicit request to start early and acknowledgement of consequences for the withdrawal right.
- Pro access is verified by EasyCart Login Wall or another EasyCart mechanism. The User may need an EasyCart account, access link, or login to the purchase e-mail address.
- If Pro access is lost, the User may continue using Free Plan features if the Service makes them available.
7. Responsibility for results and exports
- The Service helps interpret MT940 files but does not guarantee full compatibility with every bank, :86: field variant, accounting system, or import process.
- Parser, split, report, and export results must be verified before operational, accounting, tax, or banking use.
- The Provider is not responsible for decisions made solely on Service-generated results without User verification.
- The User is responsible for having the right to process the files and data loaded into the Service, including bank account, contractor, and third-party data.
8. Technical requirements
- Using the Service requires a device with Internet access, an up-to-date web browser, JavaScript enabled, and, for paid features, access to the e-mail address used for purchase.
- LocalStorage or IndexedDB availability in the browser is required for local storage, file history, and document handoff to the Pro view.
- Blocking EasyCart scripts, necessary cookies, or browser storage may prevent purchase, login, or use of some Pro features.
9. Complaints
- Complaints about the Digital Service may be submitted by e-mail to kontakt@smartbusiness.pl or support@mt940toolkit.com.
- A complaint should include data identifying the Customer, the e-mail used for purchase, service name, problem description, date of the problem, and expected resolution.
- The Provider will respond without undue delay, no later than 14 days from receiving the complaint.
- The response will be sent to the e-mail used to submit the complaint or the e-mail used for purchase.
10. Right of withdrawal
- A Customer who is a Consumer may withdraw from the agreement without giving a reason within 14 days from conclusion, subject to rules for digital services started at the Consumer's request.
- The withdrawal statement can be sent by e-mail to kontakt@smartbusiness.pl or support@mt940toolkit.com.
- If the Customer requested service start before the withdrawal period expired and then withdrew before full performance, the Customer may be required to pay proportionally for services performed until withdrawal.
- The withdrawal right may not apply where allowed by law if the Digital Service was fully performed with the Customer's explicit prior consent and acknowledgement of losing the withdrawal right after full performance.
- Refund is made using the same payment method the Customer used unless the Customer agrees to another method that does not create costs for them.
11. Intellectual property
- The Service, code, name, interface elements, page layout, descriptions, materials, features, algorithms, demo reports, and other content may be protected works or other protected goods.
- The User may use the Service only according to the Terms, the Service purpose, and the purchased access scope.
- Without explicit Provider consent, copying, resale, distribution, public sharing, modification, or commercial use of the Service or essential parts beyond normal service use is prohibited.
12. Prohibited actions
- The User may not provide unlawful content, disrupt the Service, attempt to bypass Pro access mechanisms, or use the Service in a way that violates law or third-party rights.
- Automated downloading, copying, or recreating the Service to create a competing solution is prohibited unless mandatory law provides otherwise.
13. Out-of-court dispute resolution
- A Consumer may use out-of-court complaint and claim resolution methods, including help from a competent consumer ombudsman, consumer organisations, or Trade Inspection.
- Information about available out-of-court consumer dispute resolution methods is available on the websites of the Office of Competition and Consumer Protection.
- The Provider is not obliged and does not undertake to use out-of-court consumer dispute resolution unless mandatory law provides otherwise.
14. Changes to the Terms
- The Provider may change the Terms for important reasons, in particular changes in law, Service features, pricing, payment providers, Pro access verification, or Digital Service scope.
- The current version of the Terms is available in the Service.
